BUYER: the person or business that opens an account on capiagent.com and buys a subscription. The Buyer's name, email address and billing details are those the Buyer provides at sign-up and checkout.

This agreement sets out the rights and obligations of the parties for the sale and performance of a Capi Agent software subscription bought online at capiagent.com, under Turkish Consumer Protection Law No. 6502 and the Regulation on Distance Contracts. The detailed rules for using the service are in the Terms of Service, which form an integral part of this agreement.

• Service: an AI-powered sales and customer-service assistant for ecommerce businesses (cloud software — SaaS). No physical goods are delivered.
• Plan and term: the plan (monthly or yearly), limits and add-ons the Buyer selects at checkout.
• Price: the total amount including taxes, the currency and the billing period are shown clearly at checkout before payment is confirmed. The price shown at purchase applies to that period.
• Free trial: every new account gets a 14-day free trial; no charge is made during the trial.

Payment is taken by credit or debit card, through licensed payment institutions, with 3D Secure verification. The Seller never sees or stores card details; they are processed only by the payment institution. For the life of the subscription, the Buyer authorizes each period's fee to be charged automatically to the same card until the Buyer cancels.

The service is performed electronically. The subscription becomes active the moment payment is confirmed, and the Buyer gets immediate access to the dashboard and every feature bought by signing in. There is no shipping or physical delivery. If access fails for a technical reason, the Buyer reports it to support@capiagent.com and the Seller fixes it within 2 business days.

Under Article 15(ğ) of the Regulation on Distance Contracts, there is no right of withdrawal for services performed instantly in an electronic environment. By confirming payment, the Buyer agrees that performance starts immediately and acknowledges that the right of withdrawal therefore ends.

The Buyer can, however, try the service free for 14 days before paying anything and can cancel the subscription at any time. Cancellation and refund terms are in the Cancellation & Refund Policy.

The subscription renews automatically at the end of each chosen period (monthly or yearly) until the Buyer cancels. The Buyer can cancel at any time from the billing page in the dashboard; cancellation takes effect at the end of the paid period and no further charge is made.

• The Seller provides the service as described in the Terms of Service and protects the Buyer's personal data under the Privacy Policy and the Turkish Personal Data Protection Law No. 6698 (KVKK).
• The Buyer confirms that the details given at sign-up and checkout are accurate and agrees to use the service lawfully and in line with the Terms of Service.
• If a payment is declined or reversed by the bank or payment institution, the Seller may suspend the service until payment is completed.

Where the Buyer is a consumer, complaints go to the Consumer Arbitration Committee of the Buyer's or the Seller's place of residence within the monetary limits set by the Ministry of Trade, and above those limits to the Consumer Courts. Where the Buyer is a merchant, the courts and enforcement offices of Istanbul have jurisdiction. This agreement is governed by the laws of the Republic of Türkiye.

The agreement is concluded electronically when the Buyer reads and accepts it, together with the pre-contract information, at checkout. A copy is emailed to the Buyer's registered address after payment and stays available on this page at all times.
